Terms of Service

These terms cover your use of RAKS GIS Tool and the other tools published at rakgeo.com. Please read them before you create an account. If you do not accept them, do not use the tools.
Who you are dealing with
The tools on this site are published by Saadat Ayub Khan, trading as RAK, of Muscat, Sultanate of Oman. In these terms, "we", "us" and "RAK" mean that business, and "you" means the person or organisation using the tools.

Payments are not taken by us. Our order process is operated by Paddle.com, which is the Merchant of Record for every purchase. Paddle handles the transaction, the tax and the invoice, and your contract of sale is with Paddle. Paddle's own Buyer Terms apply to the purchase itself. These terms cover your use of the software.
Your account
- You need an account to use the tools. Give accurate details and keep them current.
- An account is for one named person. Do not share your password or let others sign in as you.
- You are responsible for everything done through your account. Tell us promptly at support@rakgeo.com if you believe someone else has access to it.
- You must be at least 18 years old, and if you are signing up for an employer you must be authorised to accept these terms on its behalf.
The free trial
- New accounts get 14 days of full access. No card is taken to start it.
- The trial is the complete tool, not a reduced version.
- One trial per person and per organisation. Creating extra accounts to extend a trial is a breach of these terms.
- When the 14 days end, access stops until you subscribe. Nothing is charged automatically.
Subscriptions and payment
Subscriptions are sold on monthly, six-month and twelve-month terms. Prices are shown on the site in US dollars and are exclusive of any tax Paddle is required to add in your country.
Six- and twelve-month terms are paid up front and are not refunded part-way through, except as set out in our refund policy, which includes a 14-day window after purchase. Switching off renewal does not shorten a term you have already paid for.
If we change our prices, the new price applies from your next renewal, and we will tell you by email before it takes effect. You can cancel before then if you would rather not continue.
What you may do with the tools
While your subscription or trial is live, we grant you a personal, non-exclusive, non-transferable licence to use the tools for your own work or the work of the organisation that pays for your account.
What you may not do
- Copy, host, resell, rent, sub-license or redistribute the tools, in whole or in part.
- Take the tools apart, decompile them, or work around any part of the system that checks whether a subscription is active.
- Share one account between several people, or pass a saved copy of a tool to anyone who does not hold a live subscription.
- Use the tools to break the law, infringe anyone's rights, or handle data you have no right to hold.
Dashboards exported from the tools are yours to share freely with whomever you like. That is what the export is for. The restriction above is on the tools themselves, not on your work.
Your data stays yours
The tools read and analyse your files inside your own web browser. Your spreadsheets, maps and analyses are not uploaded to us and we never hold a copy. We own the software; you own your data and everything you produce with it. The privacy notice sets out the small amount of account information we do hold.
Availability
We aim to keep the site and the tools available, but we do not promise uninterrupted service. We may change, suspend or withdraw a tool, or take the site down for maintenance. Where a change materially reduces what you are paying for, we will tell you by email, and you may cancel and ask for a fair refund of the unused part of your term.
Once a tool is open in your browser it keeps working without a connection, so brief outages on our side do not normally stop your work.
Ending your access
You may stop using the tools at any time and close your account by writing to support@rakgeo.com. We may suspend or end an account that breaches these terms, that is used to attack or abuse the service, or where payment has failed and has not been put right. Where it is reasonable to do so we will warn you first and give you a chance to fix the problem.
No warranty, and the limit of what we owe you
The tools are provided as they are. We do not warrant that they are free of errors, or that any analysis, map, forecast or feasibility figure produced with them is accurate or fit for a particular decision. The output is an aid to your judgement, not a substitute for it. You are responsible for checking results before relying on them, and for any professional, engineering, financial or regulatory decision you take.
To the fullest extent the law allows, we are not liable for lost profits, lost business, lost data, or indirect or consequential loss. Where we are liable, our total liability to you is limited to the amount you paid us in the twelve months before the claim arose.
Nothing here excludes liability that cannot lawfully be excluded.
Changes to these terms
We may update these terms. If a change matters to you, we will email the address on your account at least 14 days before it takes effect. Continuing to use the tools after that date means you accept the new version. The date at the top of this page always shows the version in force.
Governing law
These terms are governed by the law of the Sultanate of Oman, and the courts of Oman have jurisdiction. If you are a consumer in a country whose law gives you rights that cannot be removed by contract, you keep those rights.
